UAE Gratuity Calculator: How End of Service Pay Works

End-of-service gratuity is a mandatory payment that UAE employers must make to employees at the conclusion of their employment. The legal basis is Federal Decree-Law No. 33 of 2021 (the UAE Labour Law), which replaced the previous Labour Law No. 8 of 1980 and came into force on 2 February 2022. The new law unified the gratuity calculation framework and eliminated the previous sliding-scale reduction that had applied when employees resigned from unlimited contracts.

How gratuity is calculated: Under Article 51 of FDL No. 33/2021, gratuity accrues at 21 calendar days of basic salary per year for the first five years of service, and 30 calendar days of basic salary per year for each year beyond five years. Partial years are prorated on a daily basis. To convert the daily rate, divide the monthly basic salary by 30 (not by the actual days in the month).

Gratuity cap: Total gratuity cannot exceed two years of basic salary, regardless of how many years of service have been completed (Article 51). This cap applies to the sum of all gratuity components — first five years plus additional years combined.

What counts as basic salary: Gratuity is calculated on basic salary only. Housing allowance, transport allowance, commission, bonuses, mobile allowance, and any other components of the total compensation package are excluded. This distinction matters significantly for employees whose basic salary represents a small fraction of their total package.

Resignation vs. termination: Under the current law, gratuity entitlement is the same whether the employee resigns or is terminated. The old reduction for resignation was repealed with the previous labour law (Law No. 8 of 1980) and no longer applies. Termination for misconduct under Article 120 of the Labour Law results in zero gratuity.

Free zone vs mainland: Employees working for mainland UAE employers are covered by MOHRE (Ministry of Human Resources and Emiratisation) gratuity rules. DIFC employees are not subject to MOHRE and instead participate in the DIFC Employee Workplace Savings (DEWS) scheme, a mandatory defined-contribution savings plan. ADGM employees follow ADGM Employment Regulations, which also operate a workplace savings model distinct from MOHRE gratuity. Employees of JAFZA, DMCC, and other non-financial free zones follow standard MOHRE gratuity rules.

How is UAE gratuity calculated?

Gratuity is calculated on basic salary at 21 days per year for the first 5 years of service, then 30 days per year for each year beyond 5 years. Partial years are prorated. The total is capped at 2 years of basic salary. Example: 7 years at AED 10,000/month basic = (21 × 5 × 10,000/30) + (30 × 2 × 10,000/30) = AED 35,000 + AED 20,000 = AED 55,000.

What is the gratuity cap in UAE?

Total end-of-service gratuity cannot exceed 2 years (24 months) of basic salary, regardless of total years worked. This cap is set in Article 51 of Federal Decree-Law No. 33 of 2021. Once the combined gratuity from all periods reaches 24 months of basic salary, it stops accruing — extra years of service do not increase the payout beyond this ceiling.

Do free zone employees get gratuity?

Most free zone employees — DMCC, JAFZA, IFZA, RAKEZ, SHAMS, etc. — are covered by standard MOHRE gratuity rules and are entitled to end-of-service gratuity. DIFC employees are not covered by MOHRE; they participate in the DEWS scheme instead. ADGM employees follow ADGM Employment Regulations which operate a separate savings mechanism.

Is gratuity calculated on basic salary or total salary?

If your employment contract does not specify a basic salary separately, the court may consider the total package, which is why most contracts in the UAE explicitly break out the basic component.

What happens to gratuity if I resign vs get terminated?

The old sliding-scale reduction (one-third for 1–3 years, two-thirds for 3–5 years) was repealed with the previous labour law and no longer applies.
